Contractual agreements

CONTRACTUAL AGREEMENTS
Booking: For the contractual services, only the descriptions and prices in the price list valid for the travel period apply. Age details refer to the time of the stay. For insurance reasons, all travelling persons must be named at the time of booking. In pandemic situations, the current arrival regulations on our website at www.landhausaverbeck.de apply. Information given by telephone, ancillary agreements and other consents of any kind only form part of the contract if they have been confirmed by us in writing. The contract comes into effect upon receipt of our written booking confirmation (by post or e-mail). You will receive it within a maximum of 5 days; please check the confirmation immediately for accuracy. Please transfer the deposit of 20% of the travel price within 7 days of receipt of the booking confirmation, stating your surname as the payment reference, to the following account:

If no deposit is received within the stated period, we reserve the right to send a payment reminder and to cancel the booking. The balance is due 14 days before arrival.

Arrival: The booked room is available to you from 3 p.m. Catering begins with afternoon coffee.

Departure: The booked room is available to you until 10 a.m. Catering ends with breakfast.

Cancellation: You may withdraw from the contract at any time. The cancellation must be declared in writing. The decisive factor for the time of cancellation is the receipt of the cancellation notice by us. It can be delivered by fax: +49(0)5054-269, by e-mail: info@landhausaverbeck.de or by post. Up until the start of the stay, you may have a third party take your place. In this case we only charge a rebooking fee of € 10. You remain liable for the payment of the fees by the substitute guest. If you withdraw from the contract, we may charge reasonable compensation in accordance with Sections 651a et seq. of the German Civil Code (BGB) as set out below.

In the event of cancellation, a one-off processing fee of € 45 is charged, plus a cancellation fee of:

0% of the total price confirmed at the time of booking up to 60 days before the start of the stay
20% of the total price confirmed at the time of booking 59-30 days before the start of the stay
50% of the total price confirmed at the time of booking 29-22 days before the start of the stay
80% of the total price confirmed at the time of booking 21-0 days before the start of the stay or in the event of early termination of the trip.

Data protection: We collect, process and use your data for the booking order and for our own marketing purposes within the scope of the statutory provisions. Data is not passed on to third parties outside the scope of the order. We will be happy to provide you with information about your data or block it with effect for the future.

Prices: The agreed prices include the applicable statutory value added tax. If the period between the conclusion of the contract and its fulfilment exceeds 4 months and the price generally charged by the hotel for such services increases, the hotel may increase the contractually agreed price appropriately, but by no more than 10%.

Non-smoking hotel: Our hotel is a non-smoking hotel. Smoking is therefore prohibited both in the public areas of the hotel and in the guest rooms and is only permitted in the designated areas. In the event of a violation, we are entitled to charge guests € 350 as compensation for the additional cleaning costs and for lost profit if the room concerned cannot be re-let. This also applies to the costs of a possible fire brigade call-out if a fire alarm is triggered by a guest smoking. The compensation shall be set higher or lower if the hotel proves that the damage is higher or the customer proves that it is lower.

Car park: Use of the car park is at your own risk. There is no liability for damage caused by other guests, third parties or external influences (e.g. natural events), except in cases of intent or gross negligence. Liability for damage to life, limb or health and under mandatory statutory provisions remains unaffected.
